第九十五条 人民警察在办理治安案件过程中，遇有下列情形之一的，应当回避；违反治安管理行为人、被侵害人或者其法定代理人也有权要求他们回避：
（十二）将在办理治安案件过程中获得的个人信息，依法提取、采集的相关信息、样本用于与治安管理、查处犯罪无关的用途，或者出售、提供给其他单位或者个人的；
